Properties advertisements: real estates will have to display their fees

Starting April 1st, real estates will also have to specify to the future tenants the amount of the monthly rent “all inclusive”.

Real estate’s advertisements relating a sale or a housing rental will have to be more specify. Published in the official journal, a decree of the 10th January from the “Alur Law” (for the access to housing and to town planning) imposes new obligations to the professionals who link purchasers or tenants and sellers or lessors of real estate.

From the 1st April of 2017, sales advertisements will have to systematically specify the selling price of the property and to who is to bear the costs of the intermediary, according to the decree. This selling price must include the proportion of the professional fees to the charge of the purchaser, expressed in fees include and fees exclude – in a larger print for the first one. He may not, “under any circumstances include the portion of the agency fees to the charge of the seller”. As for rental advertisements, it will alert the future tenants of the amount of the monthly rent “all included”, of settlements of service charges’ terms, of the surface and the municipality of the property, “to allow them to verify the respect of the rental fees cap created by the “Alur Law”, in force since August 2015 in Paris and expected in Lille for February 2017. 

The rental advertisement must indicate the amount of the monthly rent, increased, where relevant, of rent supplements permits by rent controls. Also must indicate the amount of the recoverable charges and as well the amount paid for the security deposit possibly required. It will specify the total amount, including taxes, of the professional's fees charged to the tenants, as well as those invoiced for the state of the property. The surface area of the property will have to be expressed in square meter of living surface. Finally, the pricing of products offered by a real estate professional, mandatory displayed in the window, will also have to be published on his website.
